General conditions

Liability in general

1. We are not liable for any damage and costs – however they may be named and/or however they may have arisen – unless they have been caused by an intentional act or omission or gross negligence on our part, if the principal or a third party performs any of the following acts, whether or not for consideration:

a. makes use of our materials and/or personnel;
b. stores or parks goods on one of our sites; or
c. has asked us to perform certain work that does not form part of any agreements that have already been concluded and we have acted in accordance with instructions given by or on behalf of the principal and/or that other third party.

2. We are not liable for any damage and/or costs – however they may be named and/or however they may have arisen – if such damage and/or costs have ensued from services, work and/or deliveries that have been provided or performed for no consideration, unless the principal demonstrates that such damage and/or costs arose as a result of an intentional act or serious errors that can be equated with an intentional act on our part.

3. We are not liable for any damage, however it may be named and/or however it may have arisen, if a principal or any third party temporarily parks a loaded or empty lorry or towed vehicle on one of our sites.

4. We stipulate all statutory and contractual defences that we are entitled to invoke in order to contest our own liability towards the principal or any third party, also on behalf of our subordinates and parties that are not subordinates for whose acts we would be liable under the law.

5. The provisions contained in this Article are without prejudice to our statutory liability pursuant to mandatory provisions of law.

6. The principal indemnifies us with respect to claims brought by third parties, however they may be named and/or however they may have arisen.
