General conditions

Transport

1. a. If loading and unloading is not included in the transport we will not be liable in that respect, in which case the principal indemnifies us against any claims brought by third parties, however they may be named and/or however they may have arisen.

b. If loading and unloading is included in the transport, our liability with respect to such work will be equal to our carrier liability within the meaning of Article 2(2)(a), (b) and (c) of these Terms and Conditions.

2. a. If the principal offers containers or trailers having contents for transport and we did not load those containers or trailers, we will not be liable for any damage that arises as a result of the manner in which those containers or trailers were loaded.

b. If the principle offers goods for transport that have been loaded in a container or trailer and/or placed on pallets and/or that have been packed such that it is not possible to determine the number of items and/or to inspect the contents, we will not be bound by the quantity and/or contents indicated by the principal and/or indicated in the consignment note.

c. If it is not possible for us to conduct an inspection at the time of loading and/or if an inspection would considerably delay the transport – to be determined at our discretion – we will not be bound by the number of items and/or the condition of the cargo and/or the contents indicated by the principal and/or indicated in the consignment note.

3. Under no circumstances will the principal or any third party that it engages load more (or have more loaded) than the maximum load weight permitted under the law with respect to the vehicle in question. The principal indemnifies us with respect to the consequences and/or damage that arises as a result of overloading if such overloading was caused by or was a result of the conduct of the principal and/or by or as a result of any third parties that it has engaged.
