General conditions

Customs

1. The handling of any customs formalities by us will be at the principal’s risk and expense. We are liable in respect of costs and damage that ensue from improper handling of customs formalities only if the principal demonstrates that there was an intentional act or omission or gross negligence on our part.

2. The principal indemnifies us at all times with regard to any claims brought by government authorities in respect of customs duties, taxes, excise duties, etc. on goods for which we handled the customs formalities on the principal’s instructions, unless the principal demonstrates that there was an intentional act or omission or gross negligence on our part.

3. The FENEX Conditions referred to in Article 2(2)(f) of these Terms and Conditions apply at all times.
